Francesco Marino Napoli – General Terms and Conditions of Sale

1. Online Sales Contract

An online sales contract is a distance agreement for the purchase of goods and/or services between Francesco Marino, based in San Giorgio a Cremano – Naples – Via Vittorio Bachelet, 22, and a customer acting as a consumer. The contract is concluded through the supplier’s website, francescomarinonapoli.it, using Internet-based communication.

A consumer is any natural person purchasing goods or services for personal use, not related to their professional or business activities.

These sales terms remain valid until updated by the supplier. Any changes will take effect as soon as they are published on the website and will apply to all purchases made from that moment onward.

2. Prices and Purchase Methods

All prices of the services and products displayed on the website, which constitute an offer to the public pursuant to Article 1336 of the Italian Civil Code, include VAT and any other applicable taxes, unless otherwise indicated. Where delivery is required, the cost will be clearly shown on the relevant page of the website, which the customer should review before confirming the purchase. For deliveries outside Italy, any additional charges, duties, or taxes required by the laws of the destination country will be borne by the customer.

The purchase contract is concluded when the customer accurately completes the order and gives consent to the purchase online. Customers may pay using only the payment methods indicated on the website at the time of purchase.

Shipping times:

Italy: 24–48 hours from the carrier’s collection for Ready-to-Wear ties; 3–5 business days for Made-to-Measure ties.

Europe: within 72 hours.

Americas and Australia: within a maximum of 7 business days.

Orders placed on public holidays will be processed on the next business day.

3. Buyer’s Obligations

Upon completing the online purchase process, the consumer agrees and is obliged to print and retain a copy of these general terms and conditions, which they have already reviewed and accepted as a mandatory step of the purchase process, as well as the product specifications for the purchased item. This ensures full compliance with Articles 3 and 4 of Legislative Decree No. 185/1999.

The buyer is strictly prohibited from entering false, fabricated, or fictitious data during the registration process required to execute this contract and any related communications. Personal details, including name and email address, must be accurate and belong exclusively to the buyer—not to third parties or fictional identities. Multiple registrations for the same individual or use of third-party data are expressly forbidden. The company reserves the right to take legal action against any violation or abuse in order to protect all consumers.

In the event of failed delivery by the carrier due to an incorrect address, missing information, or absence, Francesco Marino reserves the right to charge the customer for any resulting storage or handling fees.

4. Right of Withdrawal

Consumers who, for any reason, are not fully satisfied with their purchase have the right to withdraw from the contract, without any penalty and without providing a reason, within 14 business days from the conclusion of the contract. Withdrawal must be communicated by sending an email within this 14-day period to store@francescomarinonapoli.it

This right of withdrawal does not apply to products that are custom-made, clearly personalized, or which by their nature cannot be returned or may deteriorate or alter rapidly.

Within the 14-day period, all purchased goods must be returned to the supplier intact, in their original packaging, and with the fiscal receipt, without any missing items, to the following address:

Return shipping costs are the responsibility of the customer. Until the returned goods are received, the company is not responsible for theft, damage, or loss of the package in transit.

Refunds will be issued after the return has been accepted, directly to the credit/debit card or PayPal account used for the purchase, and in the same currency. Refunds should appear in your account approximately one week after our refund request, depending on banking processing times.

For all matters not specifically addressed, the provisions of European distance selling legislation shall apply.

5. Contract Termination and Express Termination Clause

F. Marino, a brand of Cassandra S.r.l., reserves the right to terminate the sales contract by providing the customer with simple notice and adequate, justified reasons. In such cases, the customer shall be entitled exclusively to a refund of any amount already paid.

6. Jurisdiction and Competent Court

Any dispute concerning the application, performance, interpretation, or breach of online purchase contracts concluded via francescomarinonapoli.it shall be subject to Italian jurisdiction. These general terms and conditions, unless otherwise expressly stated, refer to the combined provisions of Legislative Decree No. 50 of 15 January 1992 and Legislative Decree No. 185 of 22 May 1999.

For any dispute between the parties regarding this contract, the competent court shall be that of the Customer’s place of residence or the consumer’s elected domicile (Art. 1469 Bis No. 19). For all other cases, the competent court shall be that of Naples.
